Deuteronomy 15:1-2 states: “At the end of every seven years, you must cancel all debt.” New International Version of the Holy Bible.  That is why every seven years, which was then shortened to every six years, and then changed in 2005 to be every eight years for Chapter 7 and every six years for Chapter 13,  much of, if not all of your unsecured debt under US law may be extinguished (some exceptions do apply). Some debt cannot be canceled (including but not limited to income taxes less than three years old or debt based in fraud are a few examples) but generally the majority of unsecured debt (like credit cards, medical bills, family loans), if no exceptions apply, can be.

Being in debt beyond your ability to pay is of course the main signal that you are in need to consider filing a bankruptcy case. There are several common signs that give you reason to be concerned.

Those common signs are:

  • Robbing Peter to pay Paul. - Are you paying one credit card off with another one?
  • Do you have to charge on credit cards your regular living expenses, like food, gas or electric bills that you cannot pay off in full the next month?
  • Are your credit cards maxed out and have been for some time?
  • Do you have more than $15,000 in credit card debt and have you had it for more than two years?
  • Are you getting repeat calls from creditors demanding payment or a workout?
  • Are your financial pressures causing you emotional or physical problems?
  • Have you or your spouse recently been laid off or lost your job?
  • Have you recently been through a divorce or expect to go through one soon?
  • Are you having trouble with bounced checks on a regular basis?
  • Are you behind on house or car payments?
  • Are you behind on your taxes or owe the IRS?
  • Have you been sued by your creditors who are trying to collect on a debt from you?
